Please read these Terms and Conditions carefully before purchasing products or using services at any Haus of Vitality location. By making a purchase or using our services, you agree to be bound by these Terms.

1. About Haus of Vitality

Haus of Vitality is a franchise network operating across Australia. Each Haus of Vitality location is independently owned and operated by a separate franchisee entity (referred to in these Terms as “the Location”). The Haus of Vitality brand and trademark are owned by the franchisor.

When you make a purchase at a Haus of Vitality location, you are entering into a transaction with the individual franchisee operating that location, not with the Haus of Vitality franchisor or any other location within the network.

Each Location may have its own specific policies in addition to these master Terms. Please check with your local Haus of Vitality for any location-specific information.

2. Acceptance of Terms

By visiting, purchasing from, or using the services of any Haus of Vitality location, you confirm that you:

  • Are at least 18 years of age, or have the consent of a parent or guardian;
  • Have read and understood these Terms and Conditions; and
  • Agree to be bound by these Terms in relation to any transaction with that Location.

We reserve the right to update or amend these Terms at any time. The current version will always be available at each location and on any associated Haus of Vitality website or digital presence.

3. Products & Services

3.1 Product Availability

Products and services offered may vary between Haus of Vitality locations. Availability, pricing, and range are determined by each individual Location and may change without notice.

3.2 Product Descriptions

We make every effort to ensure product descriptions, ingredients, and information are accurate. However, product formulations and labelling may change. You should always read product labels carefully before use and not rely solely on information provided in-store or online.

3.3 Health & Wellness Disclaimer

Important: Products and services offered by Haus of Vitality locations are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Nothing communicated by Haus of Vitality staff, in-store materials, or associated digital content constitutes medical advice. Always consult a qualified healthcare professional before starting any new supplement, wellness programme, or health-related product, particularly if you are pregnant, breastfeeding, have a medical condition, or are taking medication.

4. Pricing & Payment

All prices displayed are in Australian Dollars (AUD) and include GST where applicable, unless otherwise stated. Prices are set by each individual Location and may differ between stores.

Each Location accepts payment methods as displayed in-store. We reserve the right to refuse a transaction at our discretion.

Promotional pricing, discounts, and loyalty offers may vary by location and are subject to individual terms at each store.

5. Refunds & Returns

Our Refund and Returns Policy applies to all Haus of Vitality purchases and forms part of these Terms. Key points to note:

  • All refund and return requests must be directed to the specific location where the purchase was made.
  • Each Haus of Vitality location is a separate business entity and cannot process returns or refunds on behalf of another location.
  • Our policies operate in addition to, and do not limit, your rights under the Australian Consumer Law.

6. Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the ACL or any other applicable legislation.

7. Limitation of Liability

To the fullest extent permitted by law, the relevant Haus of Vitality Location and the Haus of Vitality franchisor shall not be liable for:

  • Any indirect, incidental, or consequential loss or damage arising from the use of our products or services;
  • Any loss arising from reliance on information provided in-store, in marketing materials, or on any associated website;
  • Any adverse reaction to a product where you have not followed the recommended usage instructions or have not disclosed a relevant medical condition or allergy.

Where liability cannot be excluded by law, our liability is limited to the resupply of the relevant goods or services, or the cost of having them resupplied, at our election.

8. Intellectual Property

The Haus of Vitality name, logo, branding, imagery, and all associated intellectual property are owned by or licensed to the Haus of Vitality franchisor. Nothing in these Terms grants you any right to use our intellectual property without prior written consent.

Unauthorised use of the Haus of Vitality brand or any associated content is strictly prohibited.

9. Privacy

Haus of Vitality locations collect and handle personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information collected in-store (such as for loyalty programmes, purchases, or communications) is managed by each individual Location.

Please speak with your local Haus of Vitality for details on how your personal information is collected, stored, used, and disclosed. You have the right to access and correct your personal information held by a Location.

10. Loyalty Programmes & Gift Cards

Loyalty programmes, gift cards, and store credit are issued and managed by individual Haus of Vitality locations. These are generally not transferable between locations unless otherwise stated. Please confirm with your local store regarding the terms that apply to any loyalty benefits or gift card balance.

Gift cards and store credit hold no cash value and cannot be redeemed for cash.

11. Changes to These Terms

We reserve the right to update or amend these Terms and Conditions at any time without prior notice. The most current version of these Terms will be made available at each Haus of Vitality location and on any associated website. Your continued use of our products or services following any update constitutes acceptance of the revised Terms.

12. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising in connection with a purchase or service at a specific Haus of Vitality location will be subject to the jurisdiction of the courts of the state or territory in which that location operates.

We encourage customers to contact their local Haus of Vitality in the first instance to resolve any concerns before pursuing formal dispute resolution.
